Working on business plan for legal/insurance photography service. Looking for input from attorneys. Would you use a photographer for accident/injury photos? How do you handle imaging needs for your firm? What should I address in starting such a service? Thanks.Need advice for Legal Photo company. Any attorneys out there?
You should contact insurance companies to find out if they outsource their photography work. Lawyers usually get the case well after the accident and after the photos get taken. Although sometimes lawyers do need to get after-the-fact photo to use as exhibits.
With respect to the photography itself, you may want to offer both digital and film capabilities. I'm not sure about now, but at one time digital photos were not admissible in court due to the possibility of digital altering of photos. But this may be an outdated issue given the universal acceptance of digital photos in every other facet of modern life.
Otherwise, just note that a foundation will need to be laid in court to establish the admissibility of photos as evidence. Thus, you will need to be prepared to testify in court to establish that you did take the photos in question, on a particular day, at a particular time, be able to identify the subject of the photo, establish the chain of custody of the photo, state that the photo is unaltered, and that the image in the photo accurately represents the subject. Basically, you need to have accurate and well organized records for your photos.
Good luck with your new business and don't forget to send Christmas cookies to the insurance adjusters!Need advice for Legal Photo company. Any attorneys out there?
I use private investigators. They are familiar with the needs of crime and accident scene photography and the rules of evidence.
