I got a letter today from my city's court system saying that I owe about 2,600 to a credit card, which is essentially true (read ';what happened';, if interested). I've been crying all day and was wondering what to expect, what I should say or do.
I'm 22, married, rent an apartment and drive a salvaged car. We own nothing of real value.
I can't afford a lawyer, so anyone with knoledge of law or if anyone whose been down this road could throw me some advice, I would be very greatful.
WHAT HAPPENED:
Long story short: I was offered an internship to Walt Disney World through my university, but was going to decline the offer because after I figured out my finaces, I relized I would only be making enough money to live in Florida, and wouldn't be making enough to continue payments on my credit cards (I used my credit cards for tution, school supplies, car repairs, and food ONLY). My mother said that it was a once in a life time oppertunity and said that she and my aunt would pay the minimum payments for the next 6 months while I was gone, and that she didn't want me to miss out. We went back and forth and she said that with my Step-Dad's new job, and my aunts help, it would be simple. So I accepted and offered to pay them back when I got home and both declined my offer.
I left for Disney a month later and my credit card companies called me saying that this was the first time I had ever missed a paymetn...on ALL OF THEM. My mother and Aunt never once paid any of them. While I totally take respobsibility for my debt, I wish that they wouldn't have offered to do that for me, and what's more, I wish I would have never accepted their help. Like I said, I had bearley enough food for six months (we're talking Raemon Noodles) and I couldn't afford a train, bus or airplane home. My mom also said she couldn't afford it...so I was LITTERaLLY stuck there. I came home to a MOUTAIN of debt with my minimum payment being 350. I called and explained what had happened and the woman said that she couldn't lower the minimum payment. And I siad, well can I just pay you 100 a month and she informed me that I'd be throwing away my money and that I HAVE to pay the 350. I asked to speak to her superviser and she said that he wasn't in on weekends! I called back later and they told me the same thing. So I didn't pay becuase I couldn't.
I'm NOT going to sue my family for not following through. They had good intentions, things just happen.

Call the attorney's office that is on the notice you received. Explain to them that a garnishee will only send you further into the financial tubes and could possible result in your having to file bankruptcy. Tell them what you can afford and will pay each month in good faith. They do have the option to negotiate before the court date. Just remember to only offer what you can reasonably afford to pay, because if you miss even one payment, they will come after you again and will tell the judge they tried to make a reasonable arrangement with you but that you broke it and they will amost certainly get their money, possibly in the form of a garnishment. They don't have to accept just any amount, so be reasonable. Don't offer them like $10 or $15 per month, they will not accept it. Good luck. There is still time. Call the attorney that is sueing you asap or write them a letter stating that you are willing to make affordable monthly payments. Ask for a form to stop wage garnishment. they can send it to you and it has a formula you can figure out what the minimum payment is based on your income. Do it right away because they only give u like 15 days to get the form back to them!
I feel for you. This happened to me also! I was in college and had 2 credit cards and my parents called and said they needed rent money and asked if I could loan them money and they would pay me back in monthly payments. I took out a cash advance on my credit card and they never did pay me back. I knew deep down inside I wouldn't see the money but how could I say no to my mom on the phone saying they might be getting evicted?!?! Anyways since it was cash and not purchases that I used it for the interest was through the roof and I was going to school full time and only working part time so needless to say I fell behind on both cards!
