My family and I jusr recently lost our home and everything in and around it due to fire. Fortunately, no one was hurt. We were renting to own, and not insured. The house aside, I have tallied up approx. 200,000 worth of our belongings. This does not include a value on ';priceless and irreplacable'; items, such as baby photos, antiques; nor does it include my portfolio and all of my work (about 20 years worth) as an artist. Not to mention all of my airbrush equipment.
We were having some financial trouble, power had been cut off.
I had rented a generator from a LARGE company. It would seem as though that is how the fire started. My spouse and another witnessed.
My spouse, not dealing with the stress very well, has ended up in jail, (I think he just ';snapped';) after a confrontation with another party. I have been left to fend for myself and baby. My spouse has taught me to be resourceful,.. the art of survival. But, running out of resources. Lawyer I talked to not interested in the case.Just lost ALL in house fire. no one hurt. No lawyer. no insurance. Have to sue big company. Any advice?
First, the loss you sustained was the fair market value of the items at the time of the fire, not replascement cost or what you paid. I suspect that is a lot less then $200,000. Unless you have sold some of your art for big bucks, you can pretty much forget recovering for that.
If you rented a generator after power had been cut off for nonpayment, and hooked it into the house electrical system, the chances are you did not hook it up properly, which is what caused the fire. That means you are responsible and may be sued by the homeowner and the generator company (I assume the generator was lost in the fire).
You have to prove that the generator company was negligent in some way that caused the fire. Since you are so eager for money, some might even suspect you deliberately set the fire to go after the generator company. If you were having financial trouble, where did the money come from to rent the generator?
The only lawyer you will find interested in this case is one who takes money up front as a retainer, and you will have to pay for the expert witnesses and tests needed.Just lost ALL in house fire. no one hurt. No lawyer. no insurance. Have to sue big company. Any advice?
Ok i am no expert but i like you dont like to be stuck when ther might be stuff i can afely do for myself to get things to be better.First of I am happy no one was hurt and that you and the baby are ok,For the hubby i hope he finds his way again..back to your side.
Ok this is what i wold do. I probely trye to get incontact with the fierhouse to se if they know the way to go. Get a fierinspectors report. Se if you can find a PI and a Lawer that can do some digging on this and maby represent you. Think creatively.. OK OK this sond like a bad movie.. but It is a way to start. Have you tryed having a Open dialog with the Company you rented the generator from?
Look for clews and ways in to bild your case.
Good luck, I dotn know wher you live lady..but i thik most conteys have legel servises that offers free consultation.. find one in your aria. Make pipol here you.
talk to the fire department and see what they suggest.
and i wish you and your family the best of luck for the future as it sounds like you need it.
don't forget legal aid.
I would start by writing out exactly how the fire started and how it spread. Have each witness do this separately. Letting them ';work together'; would be cheating. Then figure out exactly why the fire is their fault and not yours. If the generator caught fire and burnt your house down, I'd be curious how close you had the generator to your house. They might get off the hook if they can argue that it's your fault by not taking appropriate precautions. Have a mechanic look at the generator and ask the mechanic how the generator caught fire. Have all this written down before you go looking for another lawyer. If the generator needed maintenance or something, it might be the company's fault.
you need to get a copy of the statement from the fire department. then take to a lawyer explain your story. if the lawyer turns you down, go to another. but don't give up. i'm sorry that you lost everything you owned. good luck.
Go get you a lawyer and ask the fire chief if he could tell you the reason for fire and if it is the gas sue the gas company and so on....
you do need to get a lawyer and there are ones out there that will help, you need to research to find one to take your case.
