Legal advice for naming a company?

i am starting a business and trying to come up with a name. when considering them do i need to search and see if there are companies with that same name? there are so many companies out there that have the same name, some spell it the same, others dont. what are the requirements for this? do you have to be in different industries? example i am thinking about at the moment is dell and del. dell sells computers, del makeup. (i am not considering that name btw, just an example of two different companies with the same name. plus do i need to register it in my state, federal government or something? any advise is greatly appreciated as i am just starting out and all this is totally new to me. thanks so much!Legal advice for naming a company?
Here is a totally different approach to getting a name that is fun and involves your friends.

There are also some other angles which you must pay attention to.

You will need to register your company name with

the local authorities like the companies registry or

similar office where you live.

You should keep some alternative names ready.

When you give them your first choice of name,

they should do the name search through their

computers and tell you if that name is available or not.

If not available try for your next choice!

Good luck friend.

You can find some info on this website, http://www.irs.gov/businesses/small/article/0,,id=99336,00.html

there's also links to your local offices. If you can't find them do a search for small business in ';whatever state you're in'; you might find some resources. Good luck!
